Nobody knows exactly, but probably the first counterfeit dates back since the introduction of the coin in human society. Services Provided by the Romanian Anticounterfeiting Association


In countries where democracy and market economy are currently strengthening, countries that were led by dictatorial regimes or centralized economies, freedom has lead to a real explosion on the market of services and large consume goods. Taking into account that the legislation for the protection of intellectual property rights and trademarks in these countries appears and is strengthening with time, the state’s control bodies do not always manage to fight efficiently against counterfeiting. Cosmetic products, medicines, textiles, food, cellular phones, music or software CDs, spare parts for motor vehicles, these represent a multitude of counterfeited products, thrown on the market, under renowned trademarks, for attractive prices. Who is losing from the sale of these counterfeited products? The companies holding the rights for the original products are losing. Or, these companies are investing in development, and this deprives them of some of the funds required for research. The state is losing, by the decrease of taxes received, due to the fact that the sales of counterfeited products are mostly accomplished by tax evasion. The buyers are losing, because although the purchase renowned goods for low prices, they are buying doubtful quality goods that do not satisfy their necessities. If we consider food and medicines, counterfeited products are endangering even the consumer’s health. Under these circumstances, what needs to be done?
 
 
How can you accomplish a partnership with the Romanian Anticounterfeiting Association?
The solution is available for any holder of counterfeited trademark. By entering into a partnership, by signing a contract with the Romanian anti-Counterfeiting Association, a series of advantages may be achieved. The services provided are detailed below.
 
 
I. MARKET MONITORING
- Use of network of investigators and persons appointed in the territory, all over the country, to signal counterfeiting cases and to notify them to the central office in Bucharest, where they shall be centralized;
- Periodic reports regarding the presence on the market of counterfeited and original products: localization, market segments, interest for buyers;
- Drawing-up a risk analysis: counterfeiting a trademark on Romanian territory;
- Gathering information, data, images regarding the commercialized counterfeited products as well as companies that are selling them;
- Drawing-up a file for each counterfeited trademark;
- Accomplishing a contact on local level with local authorities that are activating against the counterfeiting phenomenon (police bodies, Financial Guard, County Offices for the Consumers Protection, customs bodies, Office for the Prevention and Control of Laundering Money etc.);
 
 
II. LOBBY ACTIONS ON THE LEVEL OF ADMINISTRATIVE AUTHORITIES
A. POLICE
o Representing the specific interests of intellectual property rights holders;
o Organizing training courses for police workers in the counterfeiting field, equipping them with adequate instruments and apparatus for counterfeits tracking;
o Creating a database of certain information useful for the police in the anti-counterfeiting fight with access by user and password;
o Providing data and information for police bodies for the purpose of products’ expertise and documentation required for tracking down counterfeiting cases;

B. CUSTOMS AUTHORITIES
o Representing the specific interests of intellectual property rights holders;
o Organizing training courses for customs workers in the counterfeiting field;
o Organizing training courses for police workers in the counterfeiting field, equipping them with adequate instruments and apparatus for counterfeits tracking;
o Creating a database of certain information useful for the police in the anticounterfeiting fight with access by user and password;
o Providing data and information for police bodies for the purpose of products’ expertise and documentation required for tracking down counterfeiting cases;

C. CONSUMER PROTECTION AUTHORITIES
- Carrying out joint actions, mutual information with regards to the counterfeiting cases and access to related databases;
- Organizing training courses for territorial workers in view of improving tracking down of counterfeiting cases;
- Organizing training courses for police workers in the counterfeiting field, equipping them with adequate instruments and apparatus for counterfeits tracking;
 
 
III. LOBBY ACTIONS ON THE LEVEL OF LEGISLATIVE AUTHORITIES
- Organizing conferences to promote the specific interests of intellectual property rights holders;
- Drawing-up normative acts projects for the protection of the specific interests of intellectual property rights holders;
- Accomplishing contacts with similar international bodies for the purpose of exchanging data, information, images that would lead to the protection of the intellectual property rights holders, involving persons of the legislative apparatus;
 
 
IV. LODGING IN COMPLAINTS, COURT REPRESENTATION AND FORCED EXECUTION TO RECOVER PREJUDICES
- Lodging in complaints to the police bodies or in court, on behalf of the intellectual property right holder or of the counterfeited trademark owner;
- Drawing-up an evaluation report to determine the prejudices caused by the product’s counterfeiting;
- Requesting prejudices in court on behalf of the intellectual property right holder or of the counterfeited trademark owner;
- Forced execution of the debtor to recover the prejudices ascertained by the court and their payment in favour of the intellectual property right holder or of the counterfeited trademark owner;
 
 
V. POPULARIZATION OF COUNTERFEITING CASES TRACKED DOWN AND FINALIZED BY FILING LAWSUITS
- Organizing press conferences, publishing notifications, display on association’s website, press releases;
- Publishing informative bulletins, popularization in the association’s magazine;
